SAN JOSE — A judge on Tuesday dismissed a murder charge against a San Jose woman who had claimed self defense in a shootout that ended in the death of a 13-year-old boy in front of her home last summer.

Margarita Santillan, 39, was charged with murder and three counts of attempted murder in the Aug. 11, 2021 shooting. From the outset, she and her public defender argued she was protecting her family and home from a group of teens, one of whom was smashing in her truck with a baseball bat while another stood watch while holding a handgun.
