In a decision that cited Andy Warhol, Jeff Koons and 2 Live Crew, a federal judge declined to dismiss a complaint against Donald Trump over the use of the ’80s hit “Electric Avenue” in a campaign video.
The lawsuit by singer-songwriter Eddy Grant alleges copyright infringement through the use of the song in a 55-second animated video that Trump tweeted on Aug. 12, 2020. It portrays the Trump campaign as a sleek, red train while Joe Biden rides a creaky handcart.
